Privacy Notice for the Use of the acoust IQ App
Privacy Notice pursuant to Articles 13 and 14 GDPR: BBM Testlab GmbH, Helmut-A.-Müller-Straße 1–5, 82152 Planegg, Germany (hereinafter “BBM Testlab”, “we” or “us”), has developed an app for sound level measurement (“acoust IQ”) and makes it available for use. Below, we provide information in accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR) regarding the processing of your personal data when using the app.
1. Controller

2. Processing of Personal Data When Using the App
You can download our app free of charge from the App Store, install it on your mobile device, and use it to measure sound levels (noise / loudness).
2.1 Type and Scope of Data Processing
2.1.1 Downloading the App When downloading the app, the necessary information is transferred to the App Store, in particular your name, email address, the time of download, and your device ID (“master data”). In addition, the App Store may independently collect further data and provide you with analysis results. We have no influence on this data processing and are not responsible for it. We only process data insofar as it is necessary to download the app to your device.
2.1.2 Using the App When using the app, you record sound levels (noise) as desired. In exceptional cases, these may contain personally identifiable information (“usage data”). Usage data is stored locally on your device. We do not have access to this data. Measurement results are also displayed and stored locally without access by us.
2.2 Purpose and Legal Basis
2.2.1 We process the master data required for downloading the app in order to make the app available to you upon your request. The legal basis is Article 6(1)(b) GDPR (performance of a contract).
2.2.2 Log file data is processed in order to (1) deliver the app properly, (2) optimize functionality, and (3) ensure long-term stability and performance.
2.2.3 Usage data is stored solely on your device. We do not have access and do not process this data.
2.3 Data Retention
We retain your personal data only as long as it is necessary to fulfill the respective purpose.
2.4 Obligation to Provide Data
There is no legal or contractual obligation to provide the aforementioned data. However, collecting master data and some log file data is required to provide the app. If you do not provide this data, you may not be able to use the app.
2.5 Recipients of Personal Data
2.5.1 Disclosure to Third Parties We only disclose your personal data to third parties when necessary for the respective purposes. Transfers to countries outside the EU/EEA only occur if an adequacy decision has been issued by the European Commission in accordance with Article 45 GDPR, or if appropriate safeguards in accordance with Articles 44 et seq. GDPR are in place.
2.5.2 Service Providers We use selected service providers to support the app’s functionality. These providers process personal data on our behalf and only to the extent necessary for their respective tasks. This includes providers for hosting, maintenance, development, and services related to measurement and evaluation. All such processing is based on data processing agreements in accordance with Article 28 GDPR.
3. Data Subject Rights
If the legal requirements are met, you have the following rights: Right of access (Article 15 GDPR), Right to rectification (Article 16 GDPR), Right to erasure (Article 17 GDPR), Right to restriction of processing (Article 18 GDPR), Right to object (Article 21 GDPR), Right to data portability (Article 20 GDPR) Restrictions under Sections 34 and 35 of the German Federal Data Protection Act (BDSG) may apply to the rights of access and erasure.
You also have the right to lodge a complaint with a supervisory authority (Article 77 GDPR in conjunction with Section 19 BDSG). The competent authority for us is:
